Rules for using the Nairobi Lens website published by Nairobilens.

These Terms of Service (“Terms”) govern your access to and use of the website operated by Nairobilens that publishes Nairobi Lens (the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. The service

Nairobilens provides a digital news and media experience, including articles, explainers, multimedia, and embedded third-party content (for example, video players). We may add, change, or remove features over time. We do not guarantee uninterrupted or error-free operation.

2. Eligibility

You may use the Site only if you can form a binding contract under applicable law. If you are under the age of majority where you live, you may use the Site only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

4. User conduct

When you use interactive features (such as contact forms, or any comments or submissions we may enable), you agree not to:

  • Impersonate any person or entity, or misrepresent your affiliation
  • Attempt unauthorised access to the Site, our systems, or other users’ data

We may remove content, block access, or take other appropriate action for conduct we reasonably believe violates these Terms or harms the Site or others.

5. Submissions and feedback

If you send us ideas, tips, story leads, or other materials (“Submissions”), you grant Nairobilens a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, display, and distribute the Submissions for the purpose of operating, promoting, and improving the Site and our journalism, unless we agree otherwise in writing. You represent that you have the right to grant this licence. We are under no obligation to use or respond to Submissions.

The Site may contain links to third-party websites or embed third-party content. We do not control and are not responsible for third-party sites, services, or practices. Your use of third-party services is at your own risk and subject to their terms and policies.

7. Disclaimers

The Site and all content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by applicable law, Nairobilens and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Site.

Our total liability for any claim arising out of or relating to the Site or these Terms shall not exceed the fees you paid us (if any) for the specific paid service giving rise to the claim in the twelve (12) months before the claim. Where the Site is provided without charge for that claim, that amount is zero. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

9. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Nairobilens and its personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from your Submissions, your violation of these Terms, or your violation of third-party rights.

10. Advertising and sponsored content

We may display advertising or sponsored or partner content. Paid or sponsored material will be labelled in line with our editorial standards where applicable. We are not responsible for claims made by advertisers or sponsors.

11. Changes to these Terms

We may modify these Terms at any time. We will post the updated Terms on the Site and update the “Last updated” date. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms. If you do not agree, stop using the Site.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law rules that would require another jurisdiction’s laws to apply. You agree that the courts of Kenya have exclusive jurisdiction over disputes arising from or relating to these Terms or the Site, subject to any non-waivable rights you may have under mandatory consumer protection rules in your country of residence.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
